MAKING
A WILL: |
| We
will advise you on all aspects of drafting your Will
and planning your estate in the most tax efficient manner,
including the setting up of trusts. We will advise you
in relation to Inheritance Tax matters and how they
might affect your estate. By making a Will you decide
who will be your Executor and what will happen to your
property and how your business and affairs will be managed
after your death. If you do not make a Will, your estate
will be distributed by the Rules of Intestacy under
the Succession Act, 1965, i.e. the law will decide who
will be your Executor, your beneficiaries and the share
which each beneficiary will receive on your death. You
can see, therefore, that for the security and welfare
of your family, you should make a Will. If you have
not done so yet why not give us a call and avail of
our practical and jargon free will-making service. |
|
Even
if you have made a Will, please remember to review
it regularly to ensure that it still reflects your
wishes.Where necessary, we can call to your home to
take instructions.
|
| PROBATE: |
When
a person dies and has made a Will, it is necessary to
take out a Grant of Probate in order to deal with his/her
property. This requires dealing with the Revenue Commissioners,
completing Inheritance Tax returns, making an application
to the High Court Probate Section, obtaining Tax Clearance
Certificates, having property transferred or sold. |
If
a person dies without having made a Will, he dies Intestate
and the Rules of Intestacy apply, this can be explained
to you by your Solicitor. The next of kin must apply
to the High Court to have one person appointed to be
the Administrator of the Deceased’s estate. |
We
understand that this is a very difficult and sensitive
time for the family, our aim is to support and assist
the next of kin with the minimum of stress and upset,
to assist them in preparing the documentation for the
Revenue Commissioners and the High Court, to complete
the Inheritance Tax Returns, to assist in the sale of
the assets and where possible ensure a speedy conclusion
to the administration of the estate. |
